General description:
The company Feldschlösschen, headquartered in Rheinfelden near Basel, has been brewing beer for over 135 years and currently employs some 1,300 people across Switzerland. The Feldschlösschen Beverage Group produces an estimated 340 million litres of beer and mineral water a year at its three production sites.
The Feldschlösschen Beverage Group company formerly known as GastroLease AG runs various leased businesses across Switzerland.
KATAG & Partners AG has spent more than a decade providing support to more than 30 businesses, assisting them with the technical and commercial management of lease agreements. Due to changes in the company's strategic direction, we have now been commissioned to restructure the businesses at the earliest possible opportunity by transferring/ceding the leases to the sublessees or terminating the lease and sublease agreements by mutual consent.
Services provided:
Full range of commercial management services:
- reviewing existing lease agreements
- reviewing rental rate policies to ensure they meet statutory requirements
- assuming accounting responsibilities and reviewing existing accounts
- recording the state of repair of the individual properties and checking the assets schedule
- reviewing contractual agreements and updating them as required (maintenance and service agreements, etc.)
Professional management and administration including the following tasks:
- collecting rental fees and utility/additional charges
- initiating debt collection and retention proceedings
- monitoring and enforcing deadlines
- drawing up heating, utility and ancillary cost statements based on documents provided by the building owner
- paying rental fees to owners/management agencies
- handling accounts receivable/payable including VAT
- declaring revenues subject to VAT for each taxable entity
- storing and archiving data in compliance with statutory guidelines and regulations
- handling transfers of lease in accordance with article 263 of the Swiss Code of Obligations in relation to direct lease agreements between owners and sublessees
Full range of commercial management services:
- determining rental rates and utility/ancillary costs based on the current market situation and the client's instructions
- monitoring market developments and reviewing opportunities to modify rental fees in compliance with the terms of the lease agreements
- arranging and collecting security deposits and similar payments
- reporting changes of tenant to the relevant authorities
- providing support to tenants for the duration of the lease agreement (at least one on-site visit a year)
- initiating eviction proceedings
- passing on of costs that are owed by tenants
- drawing up annual budgets
- arranging repair and maintenance work and supervising its performance
- organising restoration of assets to their original state
